StarKist Tuna Settlement
StarKist Tuna

Star-Kist Company settled a class action lawsuit in July 2015 that could mean $25 in cash or $50 in tuna to each purchaser. Yes, that means you, and without any proof of purchase.

Federal law requires that every 5 ounce can of tuna contains an average of 2.84 – 3.23 ounces of tuna, the remainder of the can being filled with water or oil, depending. A man named Patrick Hendricks filed a federal class action suit against Star-Kist Co. in the United States District Court for the Northern District of California, claiming that StarKist actually put an average of 2.81 – 3.11 ounces of tuna in each can.

The parties reached a settlement whereby consumers can be reimbursed by StarKist under certain conditions. First, go to the suit’s settlement site, accessible here: https://www.tunalawsuit.com/Home.aspx Second, file your claim online by using the button(s) on the left side of the screen or by regular mail. Third, you must file your claim by November 20, 2015. Fourth, you must be a resident of the United States. Fifth, you must have purchased 1 or more 5-ounce cans of StarKist:
- Chunk Light Tuna in Water, or
- Chunk Light Tuna in Oil, or
- Solid White Tuna (Albacore) in Water, or
- Solid White in Oil.
Sixth, the purchases must have occurred between Feb. 19, 2009, and Oct. 31, 2014. Seventh, you must swear under penalty of perjury that you purchased that tuna during that time span. Eighth, a YouTube video explanation of this settlement and of your rights as a purchaser is accessible here: https://www.youtube.com/watch?v=U7A3-Up8MM4

Depending on the circumstances, Star-Kist may prorate your settlement payout to a lower amount; however, at least at first blush, the settlement payment will be $25 in cash or $50 in tuna.
