A class action lawsuit has been filed against DePuy Orthopaedics, Inc., a subsidiary of Johnson & Johnson, the manufacturer of metal-on-metal hip replacement implants, alleging the devices cause “irreparable harm from undiagnosed metal disease.”

The lawsuit is asking that DePuy be ordered to establish a fund to pay the costs of medical monitoring over the lifetime of all ASR XL Acetabular System hip implant patients. Those costs include annual blood and urine tests and medical imaging such as ultrasound and MRI examinations.

Tens of thousands of people could experience a DePuy ASR hip replacement failure which may require painful and risky revision surgery.

In August 2010, DePuy recalled 93,000 ASR metal hip implants after data suggested that about one in 8 may fail within five years. In September 2011, data from a British registry suggested that nearly 30% of ASR implants may fail within 6 years. The toxic metals have destroyed patients’ muscle and bone, and will potentially leave some patients with long-term disability, the study says. In addition, revisions will not last as long as the 20 to 30 years the original hip implants were expected to last.
