Once you have identified the franchise terms which are of the most concern to you, a game plan should be formulated to seek modifications from the franchiser.

The game plan involves accurately assessing the franchiser’s strengths and weaknesses as well as your own strength and weaknesses. What are the bargaining power factors? Often franchise buyers underestimate what they have to offer the franchiser.

After determining bargaining leverage, an assessment needs to be done of the real-world likelihood of the franchiser making certain specific concessions. There are some terms which are almost certainly off the table, so no time needs to be wasted on those topics. An experienced franchise attorney will know which terms are most likely to be modified.
